Whether facing a national or international commercial dispute, charges from a governmental agency, or a single-plaintiff suit with broad implications, prominent clients entrust their largest and most sensitive matters to O’Melveny. Recently, O’Melveny’s Newport Beach office defeated a US$28 million fraud, breach of contract and breach of fiduciary duty action brought against client DC Shoes and its founders by DC Shoes' former chief financial officer Clayton Blehm, who was also a major shareholder. Before the case was submitted to the jury, O’Melveny succeeded in having various claims dismissed. Then, after deliberating less than four hours, the jury rejected Blehm’s fraud and breach of contract claims and the judge entered judgment for DC Shoes on Blehm's breach of duty claim.

For example, representing International Game Technology in a patent infringement lawsuit against Aristocrat Technologies, we prevailed on summary judgment, resulting in a full dismissal of claims and a finding invalidating Aristocrat’s patent.

For example, O’Melveny has represented Resmark Equity Partners, a provider of equity and debt financing for the homebuilding industry on behalf of institutional investors, including California Public Employees’ Retirement System (CalPERS), in the majority of its transactions. We advised Resmark, partnered with an Orange County based private home builder, in the build-out of 236 lots in a master-planned community in San Diego.
